1. Acceptance of Terms
By accessing or using ToneCheck App, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.
2. Description of Service
ToneCheck App provides an AI-powered tone analysis service that helps users check their messages for potential tone issues before sending. The service:
- Analyzes text for tone, grammar, and potential social risks
- Provides feedback and optional suggestions
- Uses third-party AI providers to process your messages (see Section 8)
- May temporarily log encrypted message content for debugging purposes
3. User Accounts
To use certain features of ToneCheck App, you may need to create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. Usage Limits
ToneCheck App offers different usage tiers:
- Free Plan: 15 checks per day
- Pro Plan: 200 checks per day
Daily limits reset at midnight UTC. Unused checks do not roll over.
5. Acceptable Use
You agree not to use ToneCheck App to:
- Violate any applicable laws or regulations
- Submit content that is illegal, harmful, or offensive
- Attempt to bypass usage limits or security measures
- Interfere with or disrupt the service
- Use automated systems to access the service excessively
- Submit sensitive personal information (SSN, credit cards, passwords, etc.)
6. Intellectual Property
ToneCheck App and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.
You retain all rights to the messages you submit for analysis. We do not claim any ownership over your content.
7. AI-Generated Content
The suggestions and feedback provided by ToneCheck App are generated by AI and should be used as guidance only. You are responsible for:
- Reviewing all suggestions before applying them
- Making final decisions about your message content
- Understanding that AI suggestions may not always be perfect or appropriate for every context
8. Third-Party AI Services
ToneCheck App uses various third-party AI providers to analyze your messages. These providers may include, but are not limited to:
- Google (Gemini)
- OpenAI (GPT models)
- Anthropic (Claude)
- Open source AI models
By using our service, you acknowledge and agree that:
- Your message content will be transmitted to these third-party services for processing
- Each provider has their own terms of service and privacy policies
- We may change AI providers at any time without notice to improve service quality
- Third-party providers may process your data according to their own policies
9. Data Processing & Logging
To provide, maintain, and improve our service, you acknowledge that:
- Message content may be temporarily logged in encrypted form for debugging and error investigation
- Encrypted logs are automatically deleted after 30 days
- We use industry-standard encryption (AES-256) to protect logged data
- Access to encrypted data is strictly limited to authorized personnel
10. Disclaimer of Warranties
ToneCheck App is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that:
- The service will be uninterrupted or error-free
- All tone issues will be detected
- Suggestions will be appropriate for all contexts
- Using our service will prevent miscommunication
- Third-party AI providers will always be available
11. Limitation of Liability
To the maximum extent permitted by law, ToneCheck App shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service, including but not limited to damages arising from:
- Reliance on AI-generated suggestions
- Third-party AI provider actions or data handling
- Miscommunication despite using our service
- Service interruptions or errors
12. Subscriptions and Payments
Pro subscriptions are billed monthly or annually as selected at purchase. You may cancel your subscription at any time, and it will remain active until the end of the current billing period.
13. Termination
We may terminate or suspend your account and access to the service immediately, without prior notice, for any reason, including breach of these Terms.
14. Changes to Terms
We reserve the right to modify these Terms at any time, including changes to AI providers, data handling practices, or service features. We will notify users of significant changes by posting a notice on our website. Continued use of the service after changes constitutes acceptance of the new Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
